Defense attorney Jodi Linker said Thursday she won’t dispute that her client David DePape attacked Paul Pelosi, an encounter caught on police body camera video.

DePape has pleaded not guilty to an array of state and federal charges in the attack.

DePape is also charged with one count of attempted kidnapping of a U.S. official on account of the performance of official duties, which carries a maximum sentence of 20 years in prison.

DePape told Paul Pelosi that his wife was the “leader of the pack,” and “he had to take her out,” he testified.

In a chaotic scene, the officers rush through the door and wrestle DePape to the ground in an attempt to subdue him.

That trend has created a more complicated path for prosecutors, who must prove criminal intent to convince juries to convict DePape and the Jan.

After a judge sentenced DePape to 30 years in federal prison in May, the sentencing was reopened when prosecutors noted that the defendant was never formally given the opportunity to address the court during his sentencing.

At the time of his arrest, DePape had zip ties and duct tape.

David DePape was convicted of assault and attempted kidnapping of a federal official in November after a week-long trial in San Francisco.

DePape was given 20 years for one count and 30 years for another count.

Jury deliberations started Tuesday in David DePape’s state trial for his attack on Paul Pelosi.

May 11 (UPI) -- The Department of Justice asked a federal judge to sentence David DePape to 40 years in prison for his hammer attack on Paul Pelosi, husband of Rep. Nancy Pelosi, D-Calif., in San Francisco in 2022.

Ms. Pelosi was in Washington, D.C., and Mr. DePape instead encountered Paul Pelosi, asleep in the couple’s bedroom.

The former speaker’s husband did not hear DePape break into his home with a hammer, but he called 911 before the intruder smacked the phone out of hand, to NBC News.
