The contractor doing removal is Kiewit and the project is funded by PacifiCorp customer surcharges and California Proposition 1 water bond funds.

The Oregon Public Utility Commission rejected PacifiCorp’s proposal on Thursday, saying it would prohibit payouts for noneconomic damages such as pain, mental suffering and emotional distress.

Under the proposal, PacifiCorp would have been responsible for paying out only actual economic damages in lawsuit awards.

Backers of the dam removal say the Federal Energy Regulatory Commission could vote this spring on whether to transfer the dams’ hydroelectric licenses from the current operator, PacifiCorp, to a nonprofit formed to oversee the demolition.

Commissioners suggested the KRRC could indemnify PacifiCorp ratepayers against project cost overruns, according to the report.

The dams are owned by PacifiCorp, an Oregon-based utility that is part of Buffet’s Berkshire Hathaway Inc. conglomerate.

The letter was sent to Buffet, Berkshire Hathaway’s chairman and PacifiCorp’s president.

In addition, Oregon and Washington have signaled support for the Energy Vision 2020 initiative as part of PacifiCorp’s 2017 Integrated Resource Plan.
