In the Delaware case, shareholders claim SolarCity, a rooftop solar energy company, was secretly on the brink of bankruptcy when Tesla purchased it.

My reasoning was simple: Though at the time it was an industry leader in the rooftop solar panel sector, SolarCity had demonstrated a perverse reverse economics of scale in its business model.

Once among the largest installers of renewables in the country through Tesla has seen its share of the market decline significantly since its acquisition of SolarCity three years ago.

Per Bloomberg, the e-commerce giant said Friday that one of its warehouses in Redlands, California, also experienced a rooftop blaze connected to a SolarCity solar panel system in June of that year.

The recent revelations related to the former SolarCity were accompanied by the unexpected resignation of Tesla co-founder J.B. Straubel, the company’s long-time chief technology officer.

In addition to SpaceX, Musk is also the co-founder, CEO, and product architect of Tesla, as well as chairman of SolarCity.

Tesla already has plenty to worry about as Model 3 production lags, but $2.9 billion in debt—tied to subsidiary SolarCity—is approaching its due date.
